ARTICLE 1: SCOPE OF APPLICATION AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1.1. SCOPE

These general conditions of sale apply to all sales concluded through the website https://la-maison-du-porte-cle.com/ (hereinafter the “Site”).

La Maison du Porte-Clé ® products are exclusively intended to be sold to final consumers who are natural or legal persons, to the exclusion of all resellers, or intermediaries acting on behalf of resellers. Consequently, the customer affirms that he acts as a final consumer and that he does not intend to resell La Maison du Porte-Clé® products. for commercial purposes.

La Maison du Porte-Clé® may update these General Conditions of Sale at any time and without notice. You can read the version of these General Conditions of Sale in force at any time by clicking on the “CGV” link located at the foot of the page. The General Conditions of Sale in force at the time of the conclusion of the sales contract are those which are binding on you.

1.2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

These General Conditions of Sale as well as the prices are expressly approved and accepted by the purchaser, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general conditions of purchase, the act of purchase entailing acceptance of these general conditions of sale.

 

ARTICLE 2: ORDER TERMS

The Site allows you to order a selection of products (hereinafter the “Product(s)”) from La Maison du Porte-Clé®, immediately online via the Internet for delivery to mainland France.

The Site does not allow special orders to be placed which consist in particular of the creation of a Product that does not exist or no longer exists in the La Maison du Porte-Clé® collection, or of the adaptation or personalization of a Product from of the La Maison du Porte-Clé® collections, and in the manufacture of the latter by La Maison du Porte-Clé®. These General Conditions of Sale therefore do not apply to special orders. For any special order, please contact our Customer Service by clicking on the “Contact” link located at the bottom of the page.

Automatic recording systems are considered as proof of the nature and content of the order. La Maison du Porte-Clé® confirms acceptance of their order to the customer at the e-mail address that they have communicated. The sale will be concluded from the validation by La Maison du Porte-Clé® of payment for the order, that is to say from the date of validation of payment for orders paid online by credit card.

La Maison du Porte-Clé® reserves in any case the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

 

ARTICLE 3: AVAILABILITY OF PRODUCTS

As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the state of stock at La Maison du Porte-Clé® and of course at the suppliers. Errors or modifications may exceptionally exist, particularly in the case of simultaneous orders for the same Product by several customers.

To create our showcase and our sales catalog, we work with databases, enriched according to the information communicated by our suppliers. This database contains more than a hundred items, not all of them are stored in our reserves and our offer is then conditional on the availability of items from suppliers.

Only the permanent shortage of an item from our suppliers results in its deletion from our sales offer. In other cases, a new order within a certain period remains possible.

In the event of unavailability of the Product after placing your order, we will inform you by e-mail as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.

La Maison du Porte-Clé® incurs no liability in the event of stock shortages or unavailability of Products for orders not yet accepted by La Maison du Porte-Clé®.

La Maison du Porte-Clé® reserves the right to change the Products offered on the Site at any time and without notice. In order to ensure better quality of service and availability of our Products to all customers of the Site, La Maison du Porte-Clé® reserves the right to limit the quantity of Products that can be purchased by a customer, this in accordance with the provisions applicable in this matter and in particular those of Article L122-1 of the French Consumer Code.

ARTICLE 4: ORDER PROCEDURE

4.1. Product Selection

At any time, you can add Products to your selection by clicking on “Add to Cart”, and choose to complete your purchases or continue browsing.

You can consult your selection by clicking on the basket in the ad hoc menu where will appear: the photo(s) of the Product(s), its name(s), its characteristics, the ) quantity(s) chosen, its unit price(s), the subtotal of the selection, the delivery costs for mainland France as well as the total price of your order including delivery.

4.2. Identification

If you already have a customer account, you will need to identify yourself at this step by entering your email address and password.

If you don't have an account yet, you can continue your purchase as a guest by entering your email address.

Your usernames and passwords are strictly personal, therefore you agree to keep them secure and never communicate them to third parties. The House of the Key Holder® cannot under any circumstances be held responsible for any loss, theft or any fraudulent use of your customer account, if necessary you undertake to inform La Maison du Porte-Clé® immediately.

Creating an account allows you to:

  • Track your deliveries and view your order history;
  • Add or modify your delivery and billing addresses for your next orders;

The data recorded by the Site constitutes proof of all transactions between La Maison du Porte-Clé® and its customers. In the event of a conflict between La Maison du Porte-Clé® and one of its customers on a transaction carried out on the Site, the data recorded by La Maison du Porte-Clé® are considered valid proof of the content of the transaction.

You can deactivate your account at any time by sending an e-mail to Customer Service by clicking on the “Contact” link. After deactivating your account, you are free to create a new account at any time.

4.3. Confirmation of the order

4.3.a) Validation of the delivery method

You will need to complete the delivery information necessary for the successful shipment of your order: shipping country, title, first name, last name, telephone number, delivery address.

You can use your delivery address as your billing address or enter another one. You will then be prompted to select a payment method and enter the related information.

Once this step is completed, click on “validate”.

4.3.b) Validation of the payment method and payment of the order

At the end of the order process described above and after having accepted all of these General Conditions of Sale and Use and the Return/Refund Policy, click on the “Place my order” button. The sales contract will then be definitively formed.

You must carefully check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, in particular due to technical limitations in color rendering on your computer equipment. Therefore, La Maison du Porte-Clé® cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site.

Once completed, your order is sent to La Maison du Porte-Clé® for treatment.

La Maison du Porte-Clé® reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if La Maison du Porte-Clé® reasonably believes that this customer has violated these General Conditions or that he has engaged in fraudulent activity, or for any other legitimate reason.

4.3.c) Order confirmation

A summary of your order will then be sent to you by e-mail. The acknowledgment of receipt will include the total amount of the order, information relating to the delivery cost, the essential characteristics, the quantity and the price of the Products purchased.

We advise you to keep this acknowledgment of receipt on paper or electronically.

 

ARTICLE 5: PRICE - ACCEPTED MEANS OF PAYMENT

5.1. Price

Prices indicated in euros are deemed net, excluding shipping costs. This price includes the price of the products, the costs of handling, packaging and conservation of the products. They can be modified at any time without notice, knowing that the items will be invoiced on the basis in force when the order is registered. All orders are invoiced in euros and payable in euros. Any customs fees or local taxes remain the responsibility of the recipient.

5.2. Payment

You can pay by bank or private card (Visa card, Eurocard/Mastercard) directly on the site, in the payment form offered during the order process (secure entry by SSL encryption), by entering the type of card, the number of your card without spaces between the numbers, the control number (located on the back of your card) as well as the expiry date.

Payment is made on our partners' secure banking servers. This implies that no banking information concerning you passes through the site https://la-maison-du-porte-cle.com/.

Payment by credit card is therefore perfectly secure; your order will be recorded and validated upon acceptance of payment by the bank.

ARTICLE 6: DELIVERY TERMS

6.1. Address and Delivery Area

We deliver to your home or to a relay point. Products purchased on the Site are delivered by post (Standard Home mode):

  • In Europe: France (including Corsica), Belgium, Réunion, Guadeloupe, Martinique, Mayotte, Saint-Martin, Luxembourg, Monaco
  • In the whole world

The Products are shipped to the delivery address you indicated during the ordering process.

6.2. Delivery delay

The delivery time includes the preparation time of the package plus the delivery time. La Maison du Porte-Clé® delivers worldwide. The buyer is informed by email of the different stages of tracking their order: preparation and delivery.

The delivery time includes preparation time and delivery provided by our carrier. The announced delivery time of 10 to 25 days is valid upon receipt by the buyer of the order shipping email. The delivery time (announced by the carrier) does not commit La Maison du Porte-Clé® to a longer period.

Deadline for delivery of the order: when placing the order and upon acknowledgment of receipt of the order, a delivery time is communicated to customers. It is calculated by adding the availability time of the longest product to the delivery time of the mode of transport selected by the customer.
From placing the order to shipping it, the customer has the possibility of canceling his order.

6.3. Transportation costs

The amount of delivery costs is calculated based on the Products chosen, the total value of your order, the delivery area, as well as the delivery method chosen.

Transport costs include a contribution to preparation, packaging and postage costs. Consider grouping all your items into one order. We will not be able to combine two separate orders and you will be charged shipping costs for each of them.

ARTICLE 7: DELIVERY PROBLEMS

Any defect or delay in delivery must be reported to our Customer Service as soon as possible. Any complaint made beyond 14 calendar days after the date of receipt of your order cannot be taken into account.

If the delivery time is not met, you can cancel the order simply by email.

La Maison du Porte-Clé® will then be required to reimburse you in full for the sums paid, at the latest within fourteen (14) days following the date of termination of the sales contract. If you nevertheless receive the Product after using this option, you must return it according to the return procedures provided for in article 8 below.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature any anomalies noted (open package, damaged Product, etc.).

 

ARTICLE 8: RIGHT OF WITHDRAWAL – RETURNS, EXCHANGES, REFUNDS

8.1. Right and period of withdrawal

The items supplied by La Maison du Porte-Clé® are new and guaranteed against any defect. They are identical to those of traditional commerce and come from all the publishers and suppliers listed.

If an item is defective or non-compliant, the buyer has 14 working days from receipt of the items to request an exchange or refund. If the fourteen (14) day period normally expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.

The customer must return the new items in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use and documentation (in its original cellophane packaging and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to contact@la-maison-du-porte-cle.com (description and photos attached).

In the event of exercising the right of withdrawal, La Maison du Porte-Clé® is required to reimburse the sums paid by the customer, free of charge, with the exception of return costs. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s).

Apart from cases of reimbursement made as part of the exercise of the right of withdrawal or for lack of conformity and hidden defects, La Maison du Porte-Clé® will not reimburse the VAT applied on purchases made on the Site (even in the case where the buyer, after receipt, reships the Products to a country outside the European Union).

The return shipping costs then remain your responsibility.

In the event of a refund, we guarantee that it is made within a period of less than or equal to 14 days following the date of receipt of the returned package. No cash on delivery will be accepted, whatever the reason.

We do not exchange items unless they are defective or damaged. If you want another size, you will then have to reorder on https://la-maison-du-porte-cle.com/ .

ARTICLE 9: TERMS OF RETURNS, EXCHANGE AND REFUND

9.1. Back

As part of exercising the right of withdrawal and to be eligible for a return, your item must be unused and in the same condition as you received it. It must also be in the original packaging.

Non-returnable items:

  • Gift cards

To complete your return, we need a receipt or proof of purchase.

Please do not return your purchase to the manufacturer.

9.2. Exchange

We only replace defective or damaged items. In the aforementioned case, we invite you to contact our Customer Service via the “Contact” tab located at the bottom of the page.

9.3. Refund

In the event of a refund request, the latter will take place, in accordance with the legislation, fourteen (14) days from either receipt of proof of shipment of the Product(s), or receipt of the Product(s). (s), the date retained being that of the first of these facts. The refund, including the standard delivery costs of the initial order, will then be made using the same payment method used when ordering.

Please note, however, that an additional period may be applied by your bank during reimbursement.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you if your refund is approved or rejected.

 

ARTICLE 10: TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

The transfer of ownership of the products to the benefit of the purchaser will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said products. However, the transfer of risks of loss and deterioration of the products will only take place upon delivery and receipt of said products by the purchaser.

 

ARTICLE 11: PROTECTION OF YOUR PERSONAL DATA

La Maison du Porte-Clé® is the producer and owner of all or part of the databases making up this site. By accessing this site, the customer acknowledges that the data composing it is legally protected, and is prohibited in particular from extracting, reusing, storing, reproducing, representing or preserving, directly or indirectly, on any type of support, by any means. and in any form whatsoever, all or part qualitatively or quantitatively substantial, of the content of the databases appearing on the site to which it accesses.

 

ARTICLE 12: RESPONSIBILITY

The descriptions of the products present in the databases of https://la-maison-du-porte-cle.com/ were entered according to the information communicated by the publishers. La Maison du Porte-Clé® is not responsible for the content of the works and cannot be held liable towards the purchaser. La Maison du Porte-Clé® cannot be held responsible in the event of a force majeure event (strike, flood, fire, etc.).

The products offered comply with current French law. La Maison du Porte-Clé® declines all responsibility if the item delivered does not comply with the legislation of the country of delivery (censorship, prohibition of a title or author, etc.). La Maison du Porte-Clé® is not responsible for the content of sites to which hypertext links may refer from its own site.

Under no circumstances can La Maison du Porte-Clé® be held liable for any damage which does not result from a failure by La Maison du Porte-Clé® to fulfill one of its obligations.

 

ARTICLE 12: APPLICABLE LAW - DISPUTES

These General Conditions of Sale are governed and interpreted in accordance with French law. However, in accordance with regulation CE 593/2008 of June 17, 2008, these General Conditions of Sale do not prevent compliance by La Maison du Porte-Clé® a provision more favorable to the customer and from which it cannot be deviated by agreement, under the law where the customer has his habitual residence.

In the event of a dispute relating to the execution of an order, you have the option of resorting to a conventional mediation procedure or any other alternative dispute resolution procedure.

These General Conditions of Sale are written in French. Notwithstanding the above, in the event of a dispute, in accordance with Regulation No. 44/2001 of December 22, 2000:

  • You can refer the matter either to the court of the place where you are domiciled, or to the French courts;
  • La Maison du Porte-Clé® may refer the matter to the court of the place where you are domiciled.
